Terms of Service

These Terms of Service ("Terms") govern your use of Tell My Ads (the "Service"), operated by GetPhound LLC, doing business as Tell My Ads ("we," "us," "our"). By connecting your account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Who can use the Service

You must be at least 18 years old and able to form a binding contract. If you use the Service for a business, you confirm you have authority to bind that business and to manage the Google Ads accounts you connect. The Service is intended for business use, not personal or household use.

2. What the Service does

Tell My Ads connects an AI assistant you use (such as Claude) to your Google Ads account so you can review performance data, request changes, and build campaigns by chatting. The Service depends on third-party services we don't control, including Google Ads and your AI assistant provider. We don't guarantee those services will remain available or compatible.

3. Your account and Google access

You sign in with your Google account and authorize the Service to access your Google Ads data on your behalf. The Service can only reach Google Ads accounts your Google login already has access to. You're responsible for activity under your account and for keeping your Google login secure. You can revoke access at any time in your Google account's security settings or by disconnecting in the Service.

4. You approve every change, and you're responsible for it

Before any change is made to your Google Ads account, the Service shows you a summary of the change and asks for your approval. No change is made without your explicit approval. By approving a change, you accept full responsibility for it and its results, including any effect on your ad spend, performance, or account standing. We keep a record of each approval (the time, the change summary shown, and your confirmation).

You're also responsible for your ads' content, your budgets and bids, and compliance with Google's advertising policies and all laws that apply to your advertising.

5. AI-generated content and recommendations

The Service uses AI to interpret your requests, summarize data, and suggest or draft changes, including ad copy and keywords. AI output can be wrong, incomplete, or unsuitable for your business. Review every summary and change carefully before approving it. Nothing in the Service is professional marketing, legal, or financial advice.

6. No guarantee of results

We don't promise any particular advertising result, including clicks, leads, sales, costs, or return on ad spend. Advertising outcomes depend on many factors outside our control.

7. Ad spend

You pay Google directly for your advertising. We don't handle, hold, or bill your ad spend, and we're not responsible for charges Google makes to you, including charges resulting from changes you approved.

8. Plans, billing and cancellation

Free plan: read-only data review, at no charge. We may change or limit the free plan at any time.
Paid plans: billed in advance, monthly or annually, through our payment processor, Stripe. Subscriptions renew automatically until cancelled.
Cancellation: you can cancel anytime. Your plan stays active until the end of the current billing period, then won't renew.
Refunds: payments are non-refundable, including for partially used periods, except where required by law.
Price changes: we'll give you at least 30 days' notice before a price change takes effect on your subscription.
Taxes: prices exclude applicable taxes unless stated otherwise.

9. Acceptable use

You agree not to:

connect Google Ads accounts you aren't authorized to manage;
use the Service to create ads or campaigns that violate Google's policies or any law;
try to access other customers' data, or probe, overload, or disrupt the Service;
copy, resell, or reverse-engineer the Service, or use it to build a competing product;
share your access with people outside your business.

10. Google and other third parties

Tell My Ads is not affiliated with, endorsed by, or sponsored by Google. Google Ads is a trademark of Google LLC. Your use of Google Ads remains subject to Google's own terms and policies. Your use of your AI assistant is subject to that provider's terms and privacy policy. We aren't responsible for third-party services, including their availability, accuracy, or how they handle your data.

11. Ownership

We own the Service, including its software, design, and branding. You keep all rights to your Google Ads data and your business content. You give us permission to access and process that data only as needed to provide the Service to you.

12. Suspension and termination

You can stop using the Service and disconnect it at any time. We may suspend or end your access if you breach these Terms, if required by law or by Google, or if we discontinue the Service. If we discontinue the Service, we'll give reasonable notice where possible and refund any prepaid fees for the unused period.

13. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate.

14. Limitation of liability

To the fullest extent permitted by law:

we won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or ad spend, even if we were told they were possible;
our total liability for all claims relating to the Service is limited to the amount you paid us in the 12 months before the claim, or $100 if you haven't paid us anything.

These limits apply whatever the legal theory, and they reflect the fact that every change made through the Service requires your approval.

15. Indemnification

You agree to defend and indemnify us against claims, losses, and costs (including reasonable legal fees) arising from your ads, changes you approved, your breach of these Terms, or your violation of any law or third-party right.

16. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Montgomery County, Pennsylvania.

17. Changes to these Terms

We may update these Terms. If a change is material, we'll notify you by email or in the Service at least 30 days before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
